Swearing-in of elected governors in Kenya takes place on the first Thursday of the tenth day after the declaration of election results. This is well stated in the Assumption of the Office of Governor Act 2019.

The act stipulates the formation of the Assumption of the Office of County Governor Committee to spearhead a smooth transition of the county governments. By law in a gazette notice, the committee publishes the date, time and venue of swearing in the governor and deputy governor-elect.

Therefore, the swearing of governors and the deputy governor is a public function that is presided by a high court judge. In accordance with the act, Thursday, August 25, 2022, was the day governors-elect were sworn in office. However, Mombasa and Kakamega governor-elect were missing the list due to delayed elections in those counties.

County symbols handed over to the elected governor during a swearing-in ceremony

During the swearing-in ceremony, the elected governor takes and subscribes to the oath or affirmation of office as prescribed in the Assumption of the Office of Governor Act 2019. However, the ceremony should be earlier than 10:00AM and not later than 2:00PM.

It is during this swearing-in ceremony that the governor-elect is handed county symbols by the outgoing governor. The symbols include;

  • The county flag
  • County coat of arms
  • The constitution
  • County public seal.

After receiving these symbols the governor-elect assumes office.

Entry of county governments into Kenya’s administrative system

County governments in Kenya were established by the 2010 constitution of Kenya. The leaders of the counties are elected governors. They are elected alongside other elected leaders.
